Commercial summary
You are the trader (seller) for every meal you list. Cooqly is a digital marketplace and online intermediary: we operate the platform and payment flow but do not produce, manufacture, pack, or import your food. These terms work together with buyer-facing Terms and with any mandatory rights or obligations under EU, Lithuanian, or other applicable law.
Platform commission depends on your active chef tier: Elite 20%, Pro 15%, Business 10% (before Stripe processing fees). The rate in effect at checkout applies to each order and is retained via Stripe Connect.
If you use live streaming features, you must follow food-safety, moderation, and lawful content rules during broadcasts; violations can lead to suspension under these terms.
1. Chef eligibility and verification
You must be at least 18 years old, legally established to sell food in your jurisdiction, and pass onboarding verification checks requested by Cooqly (identity, business, and compliance information).
2. Food safety and allergen disclosure
You are solely responsible for safety, quality, storage, preparation, and legality of each meal. You must disclose allergens and ingredients accurately in line with applicable EU food information law (including Regulation (EU) No 1169/2011) and maintain valid permits or registrations.
3. Commission, payouts, and minimum threshold
Cooqly applies the active tier commission (Elite 20%, Pro 15%, Business 10%) to each paid order. Net payouts are sent through Stripe Connect on Stripe's payout schedule. A minimum payout threshold may apply (typically EUR 25, or local equivalent) before funds are transferred.
4. Cancellations and refunds
If you cannot fulfil an order you must cancel it as early as possible so the buyer can be refunded automatically. Buyer-side refund requests are reviewed by Cooqly and may be granted in line with our published refund policy and EU consumer-protection law.
5. Live content rules and account suspension
Live streams must comply with law and Cooqly moderation rules. Prohibited conduct includes harassment, hate speech, unsafe food demonstrations, misleading sales claims, fraud, or repeated no-show/late fulfilment. Cooqly may suspend or terminate your account for serious or repeated violations.
6. Tax
You are responsible for declaring income from Cooqly and for paying any applicable VAT, income tax, or social contributions in your jurisdiction.
7. Changes
We may update these terms. Material changes will be announced in the app and by email at least 14 days before they take effect. Continued use of Cooqly after the effective date constitutes acceptance.
